Competition Rules:
These are the General Competition Guidelines that regulate the relationship between participants and Fife Sports and Leisure Trust when engaging in one of our competitions, unless specific competition terms apply. By participating in any of our competitions, you agree to adhere to these General Competition Guidelines (which may be modified by us with or without prior notice) in the absence of any specific terms and to abide by our final decisions regarding all competition matters. For each competition, please refer to the competition entry page on our website for specific terms and conditions that supersede these General Competition Guidelines. Additionally, we recommend reviewing our Privacy Policy, which governs all interactions with us and outlines how we handle your personal information.
1. Our Identity
“We,” “us,” and “our” refer to Fife Sports and Leisure Trust. Our registered office is located at Music Institute, East Port, Dunfermline, Fife, KY12 7JA. We are a registered Scottish Charity (No. SC039464). Company Registration No. SC336004.
2. Changes To These Guidelines
We may need to update these guidelines in the future, such as to accommodate changes in the types or formats of competitions we host or to rectify any errors. We will aim to minimise such changes. Please periodically review these guidelines to check for updates, as we will always specify the last update date. If you continue to participate in competitions after changes to our guidelines, you are bound by the revised terms.
3. Entry Requirements
(i) The start and end dates for each competition are outlined on the competition entry page.
(ii) Participation is open to UK and Ireland residents aged sixteen (16) and over unless the competition specifies a different age limit. We reserve the right to impose age restrictions when necessary.
(iii) You are ineligible to enter a competition if you are an employee or an immediate relative of any Fife Sports and Leisure Trust employees, competition sponsors, prize providers, co-promoters, or individuals professionally associated with the competition.
(iv) Only one (1) entry per person is allowed, unless stated otherwise. Entries must include the information requested on the competition entry page, which may include your name, age, email address, postal address, telephone number, and/or answers to specific questions.
(v) The winner(s) will be selected randomly from all correct entries received and will have fulfilled the competition criteria.
(vi) Winners will be notified via email or telephone shortly after the competition draw and will receive written confirmation along with full prize details.
(vii) If we are unable to contact the winner within a reasonable time after the prize draw or close of the competition, we reserve the right to select another winner.
(viii) Our decisions regarding any aspect of the competition, including the selection of winner(s), are final.
4. Prizes
(i) All prizes are non-transferable, and no cash alternatives will be provided. We will arrange prize fulfilment. In cases beyond our control where specified prizes cannot be provided, we reserve the right to award a substitute prize of equal value. Additional terms and conditions of the manufacturer or supplier may apply to all prizes.
(i1) Winners agree that Fife Sports and Leisure Trust, its subsidiaries, affiliates, related companies, employees, and any other sponsors and prize providers bear no liability regarding the acceptance or use of any awarded prizes. We reserve the right to disqualify entrants and/or winners at our discretion.
5. License For Material Submitted By You Or Footage Filmed By You
In return for your participation in the competition, you hereby:
• Grant us the exclusive rights to film, record sound, and photograph all activities related to the competition and (if applicable) any prizes. Everything captured by the promoter through filming, recording, or photography shall be referred to as “Footage.”
• Fully assign to us all intellectual property rights in any Footage worldwide for the entire duration of any applicable rights under global law. This means that we own all rights in the Footage as long as they exist. We may request your signature on a release form, granting us rights to the Footage.
• Waive any “moral” rights you may hold in your Footage, allowing us to use it as outlined in these General Competition Guidelines. Your moral rights include the right to be acknowledged as the author and the right to object to derogatory treatment of your Footage. We need this waiver because we may not always identify you (or other users who have uploaded content) as the author, and we may need to edit or use your Footage as we see fit in our editorial judgment.
• Agree that we may use your name, likeness, voice, photographs, and/or video footage of you, biographical information you provide, and any statements made by you regarding the Footage for publicising the competition and/or the prize(s) in any media, worldwide, and without restrictions for an indefinite period.
Termination of the Footage License
If you wish to cease our use of your Footage, please inform us by submitting your details along with your removal request through our email contact form. We will endeavour to stop using your Footage. However, we are not obligated to stop using your Footage if it is already in use or incorporated into compilation packages, other programming, or sublicensed to a third party.
Your Commitments
It is crucial that the Footage you provide for a competition is your original work. Using material or Footage you did not create or that includes images or information about individuals without their consent may result in serious liability for both you and us.
Therefore, when submitting any Footage, you affirm that:
• You are the sole creator, author, and owner of the Footage you post or upload. If you are not the exclusive owner, you have obtained written consent from the owner to upload or post the material and Footage and grant us rights to use it as described above.
• Our use of your Footage will not infringe any intellectual property or other rights of third parties (e.g., trademarks, copyright, privacy rights). This includes obtaining all necessary written consents, even for underlying copyrights, such as music, lyrics, film footage, artwork, or other copyrighted material owned by others, including individuals appearing in your Footage.
• The Footage will not contain defamatory, offensive, or illegal content.
• Your Footage is free from any rights or claims under any recording contract, publishing contract, or any union, guild, or collecting society (e.g., the Performing Right Society). You agree to notify us immediately if this status changes.
6. Liability
(i) We are not liable for lost, delayed, misdirected, damaged, or undelivered entries. Incomplete and/or illegible entries will be disqualified. We shall not be responsible for technical errors affecting telecommunications networks, Internet access, or other factors that prevent entry into any competition.
(ii) We shall not be liable to you (whether under contract law, tort, statutory duty, or otherwise) for any loss or damage arising from or related to a competition.
Such as:
• Losses related to business or commercial activities.
• Unforeseeable losses.
• Loss of opportunity, goodwill, or reputation.
• Losses incurred by third parties.
• Losses caused by data loss or computer viruses.
• Infringement of rights due to third-party links to our online services, resulting in the viewing of our content within other websites.
• Losses arising from your errors, such as providing incorrect information or failing to comply with our competition and/or prize instructions.
• Losses not caused by our breach. If you have a claim against another service provider in connection with the competition and/or prizes, you must pursue that claim independently and without involving us.
(iii) We are not liable for any delays, partial or total failures in performing our obligations to the winner(s), guests, and/or parent(s)/legal guardian(s) under these General Competition Rules if such delays or failures result from circumstances beyond our reasonable control. These circumstances may include, but are not limited to, delays, changes, disruptions, cancellations, diversions, or substitutions caused by events such as war, pandemics, strikes, hostilities, civil disturbances, accidents, fire, flood, natural disasters, or situations related to third-party event organisers, transportation (including but not limited to flights, trains, coaches, buses, ferries, taxis, or cars), and third parties providing accommodation included in the prize. It is clarified that any additional costs incurred as a result will be the sole responsibility of the affected winner(s), guest(s), and/or parent(s)/legal guardian(s).
7. Data Protection
Any personal information, including but not limited to your name, age, address (including postcode), telephone number, and email address (“Personal Data”), will be processed as follows:
(i) Personal Data will be used in connection with the competition you entered.
(ii) Your Personal Data will be utilised for any purposes to which you explicitly consented during entry.
(iii) We will manage your Personal Data as outlined in these General Competition Rules.
(iv) Your Personal Data will be handled in accordance with our Privacy Policy. Your Personal Data will not be disclosed to any third party, except as required for prize fulfilment, if applicable, and only with your prior consent, if provided during entry.
(v) By entering a competition with Fife Sports and Leisure Trust, you grant permission to be contacted via email for both service-related information and promotional e-marketing. You can easily opt out of receiving such communications at any time.
8. Jurisdiction
These General Competition Rules are governed by and construed in accordance with the laws of Scotland. The courts have exclusive jurisdiction in relation to any disputes arising from these rules.
